The legal battle between Dallas Mavericks owner Mark Cuban and former coach
Don Nelson is finally over.
Nelson, now the Golden State Warriors' coach, won about $6.3 million Thursday
in his arbitration case against Cuban in a ruling by retired judge Glen M.
Ashworth.
John O'Connor, Nelson's attorney, said Nelson was very happy about the
outcome. O'Connor said the verdict cannot be appealed.

"It was not so much a defeat of Cuban as it was an ass-whipping," O'Connor
said. "Cuban's lawyers did a good job of painting lips on a pig."
Nelson filed for arbitration on his claim the Mavericks owed him more than $6
million in deferred salary from when Ross Perot Jr. owned the team.
After months of attempts by both sides to settle the dispute, Nelson took
legal action against Cuban in May 2007, not long after his eighth-seeded
Warriors upset the top-seeded Mavericks in the first round of the Western
Conference playoffs.
Nelson resigned as Mavericks coach in March 2004. He was paid for one more
season at his coaching salary, then began work in a consultant's role at a
reduced salary. Nelson took over the Warriors in August 2006, two months
after the Mavericks lost to Miami in the NBA Finals.
Cuban, who bought the team from Perot in 2000, contended taking the Golden
State job violated a no-compete clause in Nelson's contract.
"I got exactly what I wanted out of the deal, the true facts of the
situation," Cuban said in an e-mail. "I feel a lot better knowing that, under
oath, [Nelson] said that in between [the] Mavs' Finals games he was meeting
with their GM and helping the Warriors work on their draft plans, that he and
his lawyers had started discussions more than a month before he took the job,
not days as he said publicly."
Nelson didn't immediately return phone calls requesting comment.
Cuban filed a counterclaim in June 2007 alleging Nelson used inside
information to lead Golden State past the Mavericks in the first round. That
claim was denied.
Nelson's 2003 contract negotiations with Cuban were bitter, and communication
between them was never the same. The loss of Steve Nash in free agency
further deteriorated their relationship.
Beginning on June 23, the sides spent more than 20 hours over two days in
Dallas stating their cases. Both submitted post-arbitration briefings for
consideration.
Evidence revealed the Mavericks failed to pay Nelson his consulting salary
beginning July 1, 2006, according to arbitration documents.
"Unfortunately, according to the arbitrator, because I held back about
$25,000 in payments as I tried to understand the situation, I breached our
consulting agreement, so I am obligated to pay him the deferred money he was
to be paid," Cuban said. "Basically, I pay him the exact same amount I would
have had this not happened."
O'Connor said Cuban must also pay Nelson's legal fees and court costs.
