No sign of crime found in Utah Jazz case

The Multnomah County district attorney's office did not find sufficient
evidence to corroborate a nude dancer's allegations in October that two of
four Utah Jazz basketball players sexually assaulted her in a Portland hotel.
Investigators were unable to locate any physical evidence of a crime, and the
woman is no longer cooperating with police detectives or returning calls from
an assigned victim's advocate, a prosecutor said. The woman could not identify
who assaulted her.
"Absent an admission from one of the suspects, it appears unlikely that
identity will ever be established," senior deputy district attorney Don Rees
wrote in a Tuesday memo. "That fact alone bars prosecution of this case
because identity must be proven beyond a reasonable doubt."
Portland police investigated the complaint of rape and sexual abuse after an
unidentified nude dancer emerged from an elevator at the RiverPlace Hotel
about 2:30 a.m. on Oct. 23, collapsed on the floor and said, "They raped me,"
according to the prosecutor's memo.
Portland officers said the woman was screaming and crying in the hotel lobby,
appeared to be extremely intoxicated and had difficulty remaining conscious.
A hotel employee found her clothes in a fourth-floor hallway of the hotel where
Utah Jazz players Dee Brown, Deron Williams, Ronnie Brewer and Paul Millsap,
all team starters at the time, were staying, the memo states.
Police said the four players acknowledged that they met the dancer at a local
club and took her back to the hotel in a taxicab. But all four denied engaging
in sexual contact with the woman at the hotel, the memo states.
The cabdriver told investigators the woman was telling the players she wanted
to have sex with two of the men at the same time during the ride to the hotel.
He was told to stop at a convenience store so that one of the men could buy
condoms. Surveillance images from a camera inside the cab show at least two
of the players engaging in "mutual and apparently consensual sexual contact"
with the woman, the memo says.
Representatives of the Utah Jazz and the players could not be reached for
comment.
Police took the woman to OHSU Hospital for examination. She told a doctor and
police that she had been assaulted by three men and sexually assaulted by two
of them, saying they held her down and had intercourse with her. She said she
pleaded with the men to stop. She said she didn't know what happened to her
clothes or how she got to the hotel lobby.
The state crime lab found no semen or spermatozoa on the forensic evidence
kit collected from the woman.
"Although this could be explained by the use of condoms, it nonetheless means
that no extrinsic evidence is available in this case to support allegations
of intercourse," the prosecutor's memo says.
Police found no used condoms in the hotel rooms.
The four players were interviewed separately within hours of the reported
assault. Brown said he had eight alcoholic drinks at the club where he and
the other players "hooked up" with the dancer. Brown said he returned to his
room and played video games, the memo states.
Williams said he went to Brewer's hotel room with the woman, Brewer and
Millsap but later returned to his own room, according to the memo. He said
the woman was upset and crying, even though no one had touched her, and told
the men she had been raped three times in the past and didn't want it to
happen again.
Brewer said the woman stripped naked and lay on his bed uninvited. He said he
decided not to have sex with the woman because she was too drunk and acting
strange, the memo says. So he placed blankets and pillows on the bed to create
a divider and told the woman she could sleep on the bed or the floor, the memo
says. Brewer said the woman fell asleep for about 15 minutes, began crying and
walked out of the room.
Brewer said that "everyone in his group agreed not to have sex with the woman
because of her behavior and statements about being raped in the past," the
memo says.
Millsap said that he left Brewer alone with the woman for about five minutes
and that no one had sex with her, the memo says.
The woman who made the complaint told police she used ecstasy the night
before and a toxicology report found evidence of the drug in her urine,
according to the prosecutor's memo.
